CHEMICAL test refusal (CTR) PENALTIES IN MASSACHUSETTS.

Unlike OUI, the penalties for a Chemical Test Refusal (CTR) in Massachusetts is centered around the administrative loss of license. The key thing to understand with an administrative loss of license is that it occurs without a trial or court appearance.  Essentially due process is turned on it's head: rather than going to court to avoid punishment, your due process is in appealing the punishment you have already received. Rather than the Commonwealth having to prove your guilt at trial, the driver, very often through an attorney, must request a hearing. These hearings are time limited, so if you have been charged with CTR, it’s imperative that you speak to an attorney immediately to explore your options.

Administrative (Pre Conviction) CTR Penalties
The specific CTR penalties a driver faces in dependent upon your age and driving history. These penalties are IN ADDITION to any OUI suspension you may face if you are convicted.
  • Driver Age 21+
    • No prior OUI – 180 days Massachusetts driver’s license suspension.
    • 1 prior OUI – 3 years Massachusetts driver’s license suspension.
    • 2 prior OUI – 5 years Massachusetts driver’s license suspension.
    • 3 or more prior OUI - lifetime Massachusetts driver’s license suspension.
  • Driver Age Under 21
    • No prior OUI – 3 years Massachusetts driver’s license suspension.
    • 1 prior OUI – 3 years Massachusetts driver’s license suspension.
    • 2 prior OUI – 5 years Massachusetts driver’s license suspension.
    • 3 or more prior OUI – lifetime Massachusetts driver’s license suspension.
  • Any Age
    • Prior OUI with serious bodily injury – 10 years Massachusetts driver’s license suspension.
    • Prior Vehicular Homicide involving alcohol – Lifetime Massachusetts driver’s license suspension.
